Official Rules: The Rivolta Monthly Giveaway

These Official Rules (“Official Rules”) govern the Rivolta Monthly Sweepstakes (“Sweepstakes”). By entering or participating in the Sweepstakes, you (“Entrant”) agree to be bound by these Official Rules, to the fullest extent permitted by law, as well as by the decisions of Gemini Music INC., DBA Rivolta Guitars. (“Sponsor”), which shall be final and binding in all matters relating to the Sweepstakes. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited.

1. SPONSOR AND ADMINISTRATOR

Sponsor: Gemini Music INC., DBA Rivolta Guitars., 1854 Air Lane Drive Suite 17A Nashville, TN 37210 , United States. Administrator: For purposes of the prize drawing, Sponsor will utilize a verifiable random drawing method at Sponsor’s discretion.

2. SWEEPSTAKES PERIOD

The Sweepstakes operates on a recurring monthly basis. Start Date/Time: 12:00:01 AM Central Time (“CT”) on the first day of the current calendar month. End Date/Time: 11:59:59 PM CT on the last day of the current calendar month (“Sweepstakes Period”). Prize Drawing Date: On or about the fifth (5th) business day of the following calendar month. Sponsor’s or its designee’s computer system is the official timekeeping device for the Sweepstakes.

3. ELIGIBILITY

Who May Enter: The Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years of age or the age of majority in their jurisdiction of residence (whichever is older) at the time of entry. Exclusions: Employees, officers, directors, and agents of the Sponsor, its parents, subsidiaries, affiliates, advertising and promotional agencies (collectively, the “Sweepstakes Entities”), as well as their immediate family members (spouse, parents, siblings, and children) and persons living in the same household as such employees (whether related or not), are not eligible. Void Where Prohibited: The Sweepstakes is void outside the United States and wherever prohibited or restricted by law. All federal, state, and local laws and regulations apply. California Residents’ Release Acknowledgement: By agreeing to these Official Rules and entering this Sweepstakes, California residents expressly waive their rights under Section 1542 of the California Civil Code (and any similar law in other states), to the fullest extent permitted by law.

4. HOW TO ENTER
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. There is a limit of one (1) entry per person for each applicable monthly Sweepstakes Period.

Automatic Entry via Email Subscription: To be eligible for entry, a person must have submitted a subscription through the official Rivolta Guitars pop-up form or designated entry page at https://www.rivoltaguitars.com. Eligible subscribers who remain active during a Sweepstakes Period will automatically receive one (1) entry into that month's drawing. Subscribers who unsubscribe prior to the close of the Sweepstakes Period will forfeit their entry for that month.

IMPORTANT: Only one (1) entry per person per month is allowed regardless of the date of subscription. Any attempt to circumvent this limit (e.g., by using multiple names or email addresses) will result in disqualification of all related entries.

5. PRIZE

Description: One (1) $500 digital gift card redeemable exclusively on https://www.rivoltaguitars.com. Approximate Retail Value (“ARV”): $500.00 USD.

Prize “AS IS” Disclaimer: The prize is awarded “AS IS” and without any warranty, either express or implied. The gift card cannot be exchanged for cash, and no change will be given for partial use, subject to applicable state laws. All unspecified expenses relating to acceptance or use of the prize are the sole responsibility of the winner. Winner is solely responsible for all taxes associated with the prize.

6. ODDS OF WINNING

Odds of winning depend on the total number of active eligible subscribers during each specific monthly Sweepstakes Period.

7. WINNER SELECTION AND NOTIFICATION

Random Drawing: On or about the fifth (5th) business day of the following month, Sponsor will conduct a random drawing from all active eligible subscribers during the prior month's Sweepstakes Period. Subscriber status does not roll over — eligibility is determined separately for each monthly period based on active subscription status at the close of that period. Notification: The potential winner will be notified by email using the address associated with their subscription. The Sponsor is not responsible for any change of email address. Potential Winner Requirements: The potential winner must respond to the notification email within seven (7) days. If required by Sponsor, the winner may need to complete, sign, and return an Affidavit of Eligibility, Liability Release, and/or Publicity Release. Failure to respond within seven (7) days will result in disqualification and an alternate winner may be selected.

8. PRIZE CLAIM

Unclaimed Prize: If the potential winner is disqualified, found to be ineligible, or fails to claim the prize within the specified time, Sponsor may, in its sole discretion, select an alternate winner by random drawing from the remaining eligible entries.

9. PUBLICITY RELEASE

Where lawful, acceptance of any prize constitutes permission for Sponsor and its designees to use the winner’s name, likeness, voice, opinions, and/or city/state of residence for advertising, trade, promotional, and publicity purposes, worldwide, in perpetuity, without further compensation, notification, or permission.

10. GENERAL CONDITIONS

1. Maximum One (1) Entry: Any individual who attempts to exceed the entry limit by any method will be disqualified.

2. Fraud and Abuse: Any attempt to deliberately damage any website or undermine the legitimate operation of the Sweepstakes will result in disqualification.

3. Cancellation / Modification: Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes at any time.

4. Release of Liability: To the fullest extent permitted by law, by participating, you agree to release and hold harmless the Sponsor, its respective officers, directors, employees, and agents, from any and all liability for injuries, losses, or damages of any kind arising from or in connection with the Sweepstakes.

11. DISPUTES

Governing Law: Except to the extent prohibited by law, any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes will be governed by the laws of the State of Tennessee, without giving effect to any choice-of-law or conflict-of-law rules. Arbitration and Class Action Waiver: Any dispute or claim relating in any way to the Sweepstakes shall be resolved by binding arbitration, rather than in court. You agree to waive any right to bring or participate in a class action.

12. PRIVACY

Any personal information collected is subject to Sponsor’s privacy policy. By entering, you consent to the collection, use, and disclosure of your personal information for the purposes of administering this Sweepstakes.

13. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Sponsor will not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with the Sweepstakes. Sponsor’s total liability shall not exceed the cost of entering and participating in the Sweepstakes.

15. DISCLAIMER

This Sweepstakes is in no way sponsored, endorsed, or administered by, or associated with Meta Platforms Inc., Alphabet Inc., Shopify Inc., ByteDance Inc., X Corp, Klaviyo Inc., or Microsoft Corporation. Any questions, comments, or complaints regarding the Sweepstakes shall be directed solely to Sponsor.
